Unless otherwise indicated, the Site is our proprietary property
and all source code, databases, functionality, software, website
designs, audio, video, text, photographs, and graphics on the Site
(collectively, the “Content”) and the trademarks, service marks,
and logos contained therein (the “Marks”) are owned or controlled
by us or licensed to us, and are protected by copyright and
trademark laws and various other intellectual property rights and
unfair competition laws of the United States, foreign
jurisdictions, and international conventions. The Content and the
Marks are provided on the Site “AS IS” for your information and
personal use only. Except as expressly provided in these Terms of
Use, no part of the Site and no Content or Marks may be copied,
reproduced, aggregated, republished, uploaded, posted, publicly

Information collected through our Apps
In Short: We may collect information regarding your geo-location,
mobile device, push notifications, when you use our apps.
If you use our Apps, we may also collect the following
information:
Geo-Location Information: We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using our mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.
Mobile Device Access: We may request access or permission to certain features from your mobile device, including your mobile device’s bluetooth, camera, sensors, storage, reminders, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.
Mobile Device Data: We may automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.
Push Notifications: We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.
2. HOW DO WE USE YOUR INFORMATION?
In Short: We process your information for purposes based
on legitimate business interests, the fulfillment of our contract
with you, compliance with our legal obligations, and/or your
consent.
We use personal information collected via our Services or Apps for
a variety of business purposes described below. We process your
personal information for these purposes in reliance on our
legitimate business interests, in order to enter into or perform a
contract with you, with your consent, and/or for compliance with
our legal obligations. We indicate the specific processing grounds
we rely on next to each purpose listed below.

and responsibilities of DARVIS Inc.:
“data controller” means a person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be used.
“data processor” , in relation to personal information, means any person (other than an employee of the data controller) who processes the data on behalf of the data controller.
If you provide the data and the instructions, then you are the
data controller and DARVIS Inc. is the data processor.
If we determine the purposes for which we collect and use your
personal information, then we are the Controller.
We use the information we collect or receive:
To facilitate account creation and logon process. If you choose to link your account with us to a third party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract.
To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
Request Feedback. We may use your information to request feedback and to contact you about your use of our Services or Apps.
To protect our Services. We may use your information as part of our efforts to keep our Services or Apps safe and secure (for example, for fraud monitoring and prevention).
To enforce our terms, conditions and policies for Business Purposes, Legal Reasons and Contractual.
To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
To manage user accounts. We may use your information for the purposes of managing our account and keeping it in working order.
To deliver services to the user. We may use your information to provide you with the requested service.

We will only keep your personal information for as long as it is

a longer retention period is required or permitted by law (such as
tax, accounting or other legal requirements). No purpose in this
policy will require us keeping your personal information for
longer than the period of time in which users have an account with
us.
When we have no ongoing legitimate business need to process your

if this is not possible (for example, because your personal
information has been stored in backup archives), then we will
securely store your personal information and isolate it from any

6. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market
to children under 18 years of age.
We do not knowingly solicit data from or market to children under
18 years of age. By using the Services or Apps, you represent that
you are at least 18 or that you are the parent or guardian of such
a minor and consent to such minor dependent’s use of the Services
or Apps. If we learn that personal information from users less
than 18 years of age has been collected, we will deactivate the
account and take reasonable measures to promptly delete such data

In Short: In some regions, such as the European Economic
Area, you have rights that allow you greater access to and control
over your personal information. You may review, change, or
terminate your account at any time.
In some regions (like the European Economic Area), you have
certain rights under applicable data protection laws. These may
include the right (i) to request access and obtain a copy of your
personal information, (ii) to request rectification or erasure;
(iii) to restrict the processing of your personal information; and
(iv) if applicable, to data portability. In certain circumstances,
you may also have the right to object to the processing of your

request in accordance with applicable data protection laws.
If we are relying on your consent to process your personal
information, you have the right to withdraw your consent at any
time. Please note however that this will not affect the lawfulness

8. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
9. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short:
Yes, if you are a resident of California, you are granted specific
rights regarding access to your personal information.
California Civil Code Section 1798.83, also known as the “Shine
The Light” law, permits our users who are California residents to
request and obtain from us, once a year and free of charge,
information about categories of personal information (if any) we
disclosed to third parties for direct marketing purposes and the
names and addresses of all third parties with which we shared
personal information in the immediately preceding calendar year.
